In a declaration by the Delhi High Court that has enraged the entire subcontinent of India, one of the main accused in the Delhi Rape Case or Nirbhaya Case, as it is locally known, has been released from imprisonment after serving just 20 months for the heinous crime.

On December 16, 2012 a young medical student was gang-raped in a moving bus, her intestines brutally removed from her body through her vaginal canal and and left to die in the streets in the piercing cold. This unimaginable act was committed by 5 men, one of whom was 17 years and 6 months old at the time. It has been alleged by the other rapists that he was the prime committer of the act while the others were merely bystanders.

The unidentified “juvenile” was granted a release by Chief Justice G Rohini and Justice Jayant Nath as they said that as per law, he was below the age of being considered an adult. The other accused, Mukesh, Pawan, Akshay and Vinay were all sentenced to death by the Sessions Court and Delhi High Court and now their appeals are still pending before the Supreme Court Of India.

The media and citizens alike are protesting the judgement, saying that just an inhumane act should be treated as a special case and the law overlooked. The victim’s parents have stated their despair, saying: “Crime has won and we have lost (jurm jeet gaya, hum haar gaye).”

“Despite all our efforts for three years, our government and our courts have released a criminal. The assurance we were given was that we will get justice but that has not been delivered. We are very disappointed. “Although we haven’t seen him, not met him, but despite all our efforts, the criminal will walk free”.

The victim died in a Singapore hospital on 29th December of the same year.

Further action is still to be taken and the State and Central Government’s opinion is still being taken.
